Please note, references in these Terms and Conditions to "we", "us", “FitFam Ltd” and "FitFam" are to FitFam Limited (trading as FitFam). References to “you” and “your” are to the customer of FitFam Ltd. References to “us” are to FitFam Ltd as the seller and you as the customer.
Orders placed by you on the website www.fit-fam.com (the “Website”) for the products offered by us through the website are only an offer to conclude a sales contract. The sales contract is entered into upon the confirmation of the order by e-mail by us to you. The Contract between us will only be formed when we send you the Dispatch Confirmation.
You are the individual or individuals placing the order (‘you’, ‘your’). You must be 18 years or over to enter into a contract with us by placing an order with us, you confirm that you are 18 years or over.
If you are not yet 18, you agree that you have obtained the bill payer’s permission to enter in to a contract with us.
This contract is between you and us. No other person shall have any rights to enforce any of its terms. Neither party will need to get the agreement of any other person in order to end the contract or make any changes to these terms.
Placing An Order
Our shopping pages will guide you through the steps you need to take to place an order with us. Our order process allows you to check and amend any errors before submitting your order to us. Please carefully check your order at each page of the order process.
After you have placed an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.
We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched (“Dispatch Confirmation”). The Contract between us will only be formed when we send you the Dispatch Confirmation.
If we are unable to verify the delivery or payment information you have supplied we may restrict delivery to the address to which your credit or debit card is registered.
In the unlikely circumstance, for whatever reason, if we are unable to fulfil your order an email will be sent to the address supplied by yourself when you placed the order explaining the issue that may have arose.
Remember to check your basket and delivery information to ensure your order is correct before submitting the order as we may not be able to amend your order once it has been submitted.
FitFam Ltd reserves the rights to reject/cancel your order fulfilment of all orders placed by yourself on the FitFam website. We explicitly hold the right not to accept, to reject and to cancel your order for any of the following reasons:
- The product is not available / in stock
- Your billing information is not correct or not verifiable
- Your order has been suspected of fraudulent activity
- We could not deliver to the address provided by yourself
- Force Majeure
- In the event of misspelling, pricing or other errors or mistakes in the website information
Discount Codes / Promotions
Only one discount code can be used per order.
FitFam reserves the right to refuse or cancel the use of a discount code without any further discussion.
Usage of discount codes are subject to stock availability.
We accept all major credit cards (American Express / MasterCard / Visa) debit cards (Solo / Maestro / Visa Debit / Visa Delta / Visa Electron) and PayPal payments.
Your credit card or other account detailed above will be debited when you click on the “confirm” button.
All payments are processed through third party payment gateways using PCI Encryption. We do not store credit card details nor do we share customer payment details with any third parties.
Pricing and VAT
The prices shown on our website are inclusive of VAT at the prevailing rate for which we are responsible as the seller. The amount you pay will be the price indicated plus any delivery charges.
The delivery charges will depend on the delivery option that you choose and the country to where your order is being delivered. Such charges will be shown during the checkout process.
We charge you for your order in Pounds Sterling. The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Please note that customers outside of the European Union will be liable for any import duty or other taxes, fees and charges that are applied by customs or other authorities in the country of receipt. If you are unsure about whether these duties, taxes and charges might apply to your order, you should contact your local tax or customs authorities.
FitFam reserves the right to change the price of a product at any time without any forewarning. Any orders placed prior to this change cannot be amended to the revised price
Deliveries are made to the delivery address given at time of order. Customer accepts full responsibility for ensuring accuracy of information provided.
You accept and agree that we will not be held liable for deliveries that are delayed.
You accept and agree that we will not be held liable for deliveries that go missing. We will make like for like replacements if a delivery goes missing due to the fault of a third party (i.e. courier) after a sufficient time period has elapsed and after you agree to assist us in any subsequent investigations for compensation from said third party.
As stated in the cancellation policy, we will only refund outbound postage costs for the least expensive common/standard delivery method. The cost of expedited and priority services will not be refunded over and above that of the least expensive common/standard delivery method.
Countries outside of the European Union may be subject to additional duties to be paid.
As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you reside in; payment of these is necessary to release your order from customs on arrival.
The final value of your order does not include any additional duties required. The carrier, prior to delivery, should inform you of the additional duties.
If you refuse to pay the duties to release your order, the order will subsequently be returned back to the FitFam warehouse and refunded. A shipping & handling fee may be deducted from your refund.
By law, FitFam is required to state the correct amount paid for any outgoing international package. Any requests to change this information will be denied.
This warranty is valid only to the original purchaser when a new piece is purchased from us.
This warranty is invalidated if you allow a third party to repair or attempt to repair any item.
In the event of a dispute as to the cause of damage, we reserve the right to send the product to a mutually agreed independent third party assessor to determine the nature of the defect. Only if their judgement indicates a defect in material or workmanship will we repair the item.
This warranty does not cover expenses incurred by you due to a lack of proper care of your product.
Please keep your proof of purchase documents – they will be required for in order to procure warranty service in the event you wish to make a warranty claim.
Please notify FitFam Ltd within 14 days of purchase in the event that you wish to claim a replacement for a defect.
Returns & Refunds
Our Returns Policy applies to all purchases made on FitFam Ltd and are incorporated by reference in these Terms.
Returns and Exchange Policy
If you are not entirely satisfied with the product purchased, you can return the item(s) within 14 days of the e-mail confirming shipment.
Unused products, with all of the original receipts and packaging must be post-marked to us within 14 days of days of the e-mail confirming shipment for a full refund of the cost of the item(s).
The returned item(s) is your responsibility until it reaches us. For your own protection, we advise that you send the parcel tracked and signed, using a delivery service that insures you for the value of the goods. The cost of returning the item to us is your responsibility. The parcel can take up to 10 working days to be returned to our warehouse, unless sent via special delivery.
If you wish to return a Product to us, either under the rights provided by the Regulations or if you believe the Product is damaged or is the subject of a fault, and you are relying upon your statutory rights and/or you believe that the Product is covered by our warranty, you should not make further use of the Product. Use of the product can in circumstances lead to a reduction in the amount of refund you may be entitled to. See further details above for FitFam’s warranty policy.
We do not accept returns after 14 days.

Returns and Exchange Policy- Sales transactions at BodyPower (11 – 13 May; NEC Birmingham)
All items purchased from the First Edition Collection (A/W’17) and all items sold as part of the ‘’2 for £30’’ and ‘’2 for £50’’ offer are non-refundable.
All other items (limited to the Second Edition Collection – S/S’18) are subject to exchange** only.

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control.
A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:
- strikes, lock-outs or other industrial action;
- civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
- fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster;
- impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
- impossibility of the use of public or private telecommunications networks;
- the acts, decrees, legislation, regulations or restrictions of any government; and
- pandemic or epidemic.
Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.
When you transmit, upload, post, e-mail, share, distribute, reproduce or otherwise make available suggestions, ideas, inquiries, feedback, data, text, software, music, sound, photographs, graphics, images, videos, messages or other materials ("User Content") on the Site, you are entirely responsible for such User Content. You hereby grant to us a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit, and otherwise exploit such User Content throughout the world, in all media now known or hereafter developed, for any purpose whatsoever, including without limitation, developing, manufacturing, distributing and marketing products.
You represent and warrant that you own or otherwise control the rights to your User Content. You understand that by using the Site, you may be exposed to User Content that is offensive, indecent or objectionable to you.
